Terms & Conditions


• ICBC (Macau) MasterCard Virtual Card ("Card") will be issued by Industrial and Commercial Bank of China (Macau) Limited ("the Bank") in form of a card account number ("Card Number"), thus no physical card will be issued.


• Approval of this Card application and issue of the Card to you is subject to the Bank's satisfactory verification of the data stated in your application form and the documents supplied by you and to the Bank's credit policy from time to time in force. The Bank reserves the right to refuse your application without stating any reason therefore.


• You agree to be bound by the terms and conditions of ICBC (Macau) MasterCard Virtual Card Cardholder Agreement ("Virtual Card Cardholder Agreement"); a copy of which is available at the Branches/Credit Card Department or on the web site at www.icbc.com.mo.


• Immediately upon being notified of the issue of the Card, you have the responsibility to sign and return to the Bank acknowledgement of receipt of such notification. Your use of the Card shall constitute conclusive evidence of your agreement to be bound by the terms and conditions of the Virtual Card Cardholder Agreement.


• You should at your own costs and expenses obtain all computer hardware equipment and software necessary (including digital certificate) for effecting any online transaction.


• All applicable fees, charges and interest payable in respect of the issue and use of the Card are set out in the Virtual Card Cardholder Agreement.


• The Bank will issue a statement ("Statement") on a monthly or other periodic basis showing the transaction details, the current balance of the Card, the minimum payment and the payment due date. You agree to verify the transaction details of the Statement and notify the Bank in writing of any error within fourteen days from the date of the Statement. Otherwise, the Bank shall be entitled to treat all transactions shown on the Statement as correct and conclusive.


• You may choose not to settle the current balance in full, in which case you must, on or before the due date specified in the Statement, pay an amount not less than the minimum payment which shall be determined by the Bank at its sole and absolute discretion provided that it shall be at least 5% of the current balance or MOP50 whichever is the greater, plus any overdue amount and any amount in excess of your current credit line. Should you choose not to settle the current balance in full, a finance charge of 2.5% per month (minimum MOP5) will be charged on all the daily outstanding balance of the Card (including but not limited to all transactions posted to the Card before or after the due date) retrospective from the respective posting date(s), instead of the due date, until the current balance is paid in full (including any period after the Bank has obtained a judgment). The finance charge will be calculated on the basis of a 365-day year.


• If you fail to make the minimum payment in full by the due date, a late fee at the rate of 5% per month (subject to a minimum of MOP10 and a maximum of MOP100) on the specified minimum payment will be charged to the Card.


• You agree to take reasonable care of the Card Number and use the Card Number in accordance with the procedures, instructions and/or security guidelines from time to time issued by the Bank to prevent fraud.


• It is your responsibility to report as soon as reasonably practicable to the Bank and to the competent Law Enforcement of any unauthorized disclosure and/or use of the Card Number or suspected unauthorized disclosure and/or use of the Card Number.


• Notwithstanding anything contained in the Virtual Card Cardholder Agreement regarding credit period granted to you by the Bank, you shall repay all sums due to the Bank immediately upon demand.


• Provided that you have acted in good faith and with due care (including taking all necessary precautions to safeguard the Card Number and to report unauthorized disclosure and/or use of the Card Number as soon as practicable), you shall not be responsible for the loss and damage incurred:
o in the event of misuse when the Card Number has not been received by you;
o for any unauthorized transactions made after you have duly notified the Bank of the unauthorized disclosure and/or use of the Card; and
o when faults have occurred in the terminals, or other system used, which cause the Bank to suffer loss and damage, unless the fault was obvious or advised by a message or notice on display.


• You shall be fully liable for all loss and damage arising from or in connection with the unauthorized disclosure and/or use of the Card Number if you have acted fraudulently or with gross negligence, or have failed to take all necessary precautions to prevent such unauthorized disclosure and/or use of the Card Number and shall indemnify the Bank against all losses, damages, liabilities and all reasonable costs and expenses incurred as a result thereof.


• You authorize the Bank at any time to instruct or request any bank with which you may have an account to deduct from such account and repay the Bank any amount due from you to the Bank.


• You acknowledge that in the event of your default in repayment of any amount from time to time due to the Bank, the Bank is entitled to appoint debt collection agencies and/or institute legal proceedings at any time without prior notice to you to enforce repayment. You agree to indemnify the Bank against all costs and expenses reasonably incurred in connection with the appointment of debt collection agencies provided that the total collection costs recoverable against you shall be in normal circumstances not exceeding 30% of the aggregate outstanding balance of the Card, and against all legal costs and expenses reasonably incurred by us in enforcing payment via legal process.


• The Bank reserves the right to alter and amend any fees or charges and also the terms and conditions stipulated in this Virtual Card Cardholder Agreement from time to time with prior notice to you in any manner the Bank deems appropriate, irrespective of whether you have actual notice or knowledge thereof. By using the Card thereafter, you will be deemed to have accepted and agreed to such changes unless you terminate the Card in accordance with the Virtual Card Cardholder Agreement.


• The Bank may at any time without notice and without giving any reason suspend, cancel or terminate the Card and/or any services offered and/or disapprove any transaction proposed to be effected by the Card.


• The Card is the property of the Bank, and upon the Bank's demand you must unconditionally and immediately cease using it for any purpose.


• This Virtual Card Cardholder Agreement shall be enforceable in Macau and/or Hong Kong and/or any place where you or your assets may be found.


• If there is any inconsistency or conflict between the English and the Chinese versions of these terms and conditions, the English version shall prevail. In the event of any inconsistency between the terms and conditions stated herein and the Virtual Card Cardholder Agreement, the Virtual Card Cardholder Agreement shall prevail.
